Terms and Conditions for Real Estate Media
Definitions
"Client" refers to any real estate agent, broker, or property representative who has booked a service with Beautiful Listings. "Photographer" refers to Brendan Carns or any authorized representative of Beautiful Listings.
Service Area
Beautiful Listings primarily serves San Diego County and the Temecula Valley. Shoots outside this area may be subject to a travel fee, which will be communicated at the time of booking.
Scheduling and Contact Information
Appointments may be requested via text, email, or through our online booking system. An appointment is considered confirmed once both parties have acknowledged the date, time, and location. Confirmation is typically provided within 24 hours of the request.
At the Shoot
The Client or an authorized representative should be present to approve the Photographer's interpretation of the project. If no representative is present, the Photographer's judgment will be considered acceptable. The property must be cleaned, staged, and ready prior to the shoot. Properties are photographed as-is. Post-production requests for item removal are available but will incur additional charges.
Delivery
Edited images will be delivered within 24-48 hours of the shoot unless otherwise agreed upon in advance. All photos are delivered in both High Resolution and MLS Resolution. Return visits for re-shoots are subject to an additional fee.
Cancellation and No-Show Policy
Cancellations or reschedules must be made at least 24 hours before the scheduled shoot. Cancellations made within 24 hours are subject to a $25 fee. Cancellations made within one hour of the shoot or at the time of arrival are subject to a $75 fee.
Rights and Usage
Beautiful Listings retains full copyright ownership of all images and media produced. The Client is granted a non-exclusive, non-transferable license to use the content for marketing the photographed property and for personal self-promotion. This license extends to the Client's parent brokerage solely for marketing the specific property photographed. Any third-party commercial use, resale, or sublicensing of content is strictly prohibited without prior written approval from Beautiful Listings.
Ai-Generated Content and Liability
Beautiful Listings may utilize AI-assisted tools for services such as virtual staging, virtual twilight, and video visualization. These outputs are intended for marketing purposes and are clearly presented as digitally enhanced representations. Beautiful Listings is not responsible for any claims, disputes, or liabilities arising from a Client's use of AI-generated content in a manner that misrepresents the actual condition of a property. It is the Client's responsibility to ensure all marketing materials comply with applicable advertising standards, MLS rules, and fair housing regulations.
